Terms And Conditions

 

1. Information on how to enter and prize details form part of these terms and conditions. If there is any conflict between these terms and conditions and any other published material, these terms and conditions are to prevail. Entry into the competition constitutes acceptance of these terms and conditions.

2. Entry is open to Australian & New Zealand residents (“eligible entrants”). Employees of the Promoter (and their immediate families) and its agencies associated with this promotion, are not eligible to enter. Participants who are under 18 years of age must have their parent’s or guardian’s permission to enter the promotion.

3. The promotion commences at 12.01am (ADST) on 19 November 2011 and closes at 11.59pm (ADST) on 26 October 2012 (“Promotion Period”).

4. To enter, participants must log onto www.lovelibra.com.au, register their details, complete and submit their entry. There will be 11 monthly draws. There is a limit of one entry per person for the entire promotional period. Participants will be entered automatically into each relevant monthly draw.

5. The draws will take place at 12.00pm (ADST) at 15 Grosvenor Street, Neutral Bay NSW 2089. All winners will be notified by phone and in writing by email, to the email address provided by the entrant within 2 working days after the date of the draw, and winner’s of prizes valued over $250 will also have their name published in The Australian & New Zealand Herald newspapers on the dates included in the table included in condition 6.

6. There will be 11 draws. When participants enter they will be automatically entered into that month’s draw and each subsequent month’s draw until October 2012. All draws will be made from eligible entries received from 12.01am on 19 November 2011 to 11.59pm on the Entry Close Date of each month as outlined in the table below (except for draw 11 which will close on 26 October 2012). Draws and announcements will take place on the following dates;

Total value of all prizes is $9,795.

7. The Prizes are not exchangeable, transferable or redeemable for cash. Prizes will be despatched to the winners via registered post once winner has confirmed their acceptance of the prize. If a winner is under 18 years of age the prize will be awarded to the winner’s parent or guardian on their behalf.

8. Tax implications may arise from the Prize winnings. In the event that a prize, or part of a prize, becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide an alternative prize of the same theme and value as the original prize, subject to any applicable laws or written directions made under applicable State or Territory legislation.

9. The Promoter reserves the right to redraw in the event of a winner being unable to satisfy these terms and conditions or forfeiting or not claiming a Prize. If a Prize remains unclaimed or is forfeited through ineligibility or otherwise the Promoter will conduct a further draw/s at the same time and place as the original draw/s on 8 March 2013 subject to any applicable law. Any winner will be notified by phone, in writing by email, to the email address provided by the entrant, and in the case of a Major prize winner, they will have their name published in The Australian & New Zealand Herald newspapers on 15 March 2013.

10. The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including (but not limited to) any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

11. The Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or a consequential loss), or for personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law.

12. The Promoter reserves the right (subject to any applicable law) to vary the rules of any competition or any prizes offered or cancel any competition if it is no longer able to run the competition due to reasons beyond its control. The Promoter will not be liable for any loss or damage to any party arising from any variation or cancellation.

13. Entrants can only enter in their own name and use their own email address. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.

14. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.

15.The prizes must be taken as offered and cannot be varied. Prize values are GST inclusive, are in Australian dollars, are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. Individual prize supplier conditions apply.

16.The Promoter’s decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.

17.The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.

18.The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

21. All entries become the property of The Promoter. Eligible entrants consent to the use and disclosure of their information for the purposes of this competition by The Promoter and its agents associated with this competition. Eligible persons agree that by submitting an entry, you agree that the Promoter may use your email address to send information and promotions.

22. All personal details of entrants will be stored at the promoter's office. A request to access, update or correct any information should be directed to the promoter at its address set out in point 25 below. If entrants do not provide their personal information, the promoter will not be able to award the entrant with a prize under this promotion. A copy of the promoter's Privacy Policy in relation to the treatment of personal information may be accessed at www.lovelibra.com.au

23. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the promotion.

24. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
